Seller & Buyer Policy
This policy explains the rules, responsibilities and expectations for all buyers and sellers using the Marlbank OLR platform marketplace, listings, auctions and related transaction features.
This policy is designed to help create a trusted marketplace environment built around transparency, accountability, verification and fair conduct between users.
1. Purpose of this Policy
This Seller & Buyer Policy governs the conduct, responsibilities and expectations of all users who buy, sell, list, promote, enquire about or transact through the Marlbank One Loft Race platform marketplace features.
This policy should be read together with the Marlbank OLR Terms of Service, Privacy Policy, Payments & Marketplace Policy, official race rules and any listing-specific or transaction-specific notices published on the platform.
2. Marketplace Role of Marlbank OLR
Marlbank OLR may provide marketplace tools, listing visibility, communication channels, transactional support, auction support, listing moderation, payout support, fraud screening and related digital platform functionality.
Unless expressly stated otherwise for a specific managed sale, auction or escrow-style transaction, Marlbank OLR is not automatically the owner, seller or buyer of items listed by third parties.
Marlbank OLR reserves the right to manage, moderate, restrict, suspend or remove listings, accounts, messages, payouts or transactions where reasonably necessary to protect users, enforce platform standards or support legal and operational compliance.
3. Seller Eligibility and Authority
A seller may only list, offer or sell an item, pigeon, service or related offering if the seller has the lawful authority and right to do so.
Sellers must ensure that any item or offering listed on the platform is accurately described, lawfully offered and not subject to misleading claims, hidden ownership disputes or misrepresentation.
Marlbank OLR may require a seller to complete identity verification, account verification, banking verification, ownership confirmation, pedigree submission or other compliance checks before a listing is approved or before payout is released.
4. Buyer Eligibility and Conduct
Buyers must use accurate information, lawful payment methods and genuine identity details when interacting with the platform or completing a transaction.
Buyers are responsible for reviewing listing details carefully, requesting clarification where needed and satisfying themselves that an item or service is suitable before purchasing.
Buyers may not use the platform to commit fraud, submit false payment claims, abuse dispute systems, impersonate others, manipulate pricing or harass sellers or platform administrators.
5. Listing Accuracy and Seller Representations
Each seller is solely responsible for the truthfulness, completeness and legality of their listing content, including descriptions, pricing, photos, pedigree details, bird identity, health claims, ownership claims, age, condition, origin and availability.
Sellers must not post false, deceptive, manipulated, unlawful or misleading listings.
If a listing includes documents, pedigrees, proof of ownership, race performance claims or related records, the seller is responsible for ensuring those materials are accurate and lawfully used.
6. Prohibited Listings and Conduct
Listings may not include unlawful goods, stolen goods, deceptive goods, counterfeit or fraud-related offerings, prohibited material or any item or service that Marlbank OLR determines to be unsuitable for the platform.
Users may not engage in fake bidding, price manipulation, listing duplication for deceptive purposes, payment scams, impersonation, abusive messaging or transaction interference.
Marlbank OLR may remove prohibited or suspicious listings without prior notice.
7. Pricing, Offers and Availability
Sellers are responsible for setting accurate prices, declaring whether pricing is fixed or negotiable where applicable, and ensuring that listed items are genuinely available.
Buyers should not assume that a listing remains available until a transaction is confirmed through the relevant platform or seller process.
Marlbank OLR may display, reorder, feature, highlight or suppress listings based on operational, moderation, promotional or technical factors.
8. Payments and Payouts
Transactions conducted through or supported by the platform may be subject to payment verification, anti-fraud review, settlement controls, payout delays, processor checks, bank verification or legal compliance checks.
Seller payouts may be delayed, withheld, frozen, offset, reversed or refused where a transaction is disputed, verification remains incomplete, fraud risk is detected, a chargeback occurs, or legal or policy concerns remain unresolved.
Buyers and sellers remain subject to the Marlbank OLR Payments & Marketplace Policy for all matters relating to transaction handling, verification, bank details, refunds, reversals and payment security.
9. Delivery, Collection and Transfer of Risk
Unless Marlbank OLR expressly assumes responsibility for fulfilment in a specific transaction flow, delivery, collection, logistics, handover, transfer documentation, timing and possession arrangements remain primarily the responsibility of the relevant buyer and seller.
Buyers and sellers should clearly agree on collection terms, handover terms, location, timing, documentation, transport arrangements and any related costs before finalising a transaction.
Marlbank OLR may provide communication tools or workflow support, but does not automatically guarantee physical delivery or transfer outcomes unless explicitly stated in a managed transaction process.
10. Authenticity, Pedigrees and Representations
Where a listing relates to pigeons, pedigrees, breeding value, race performance, ring data, bloodline information or similar representations, the seller bears responsibility for the truth and reliability of those claims.
Buyers are responsible for carrying out their own evaluation and should not rely solely on high-level promotional wording where supporting documentation or verification is reasonably necessary.
Marlbank OLR may request pedigree-related or ownership-related proof where appropriate, but does not automatically certify every listing unless expressly stated.
11. Disputes Between Buyers and Sellers
Where a dispute arises between users, Marlbank OLR may, but is not always obliged to, review available records, communications, listing data, payment status information, submitted documents, moderation history and transaction timelines.
Marlbank OLR may temporarily freeze payouts, restrict access, request evidence, suspend listings, block accounts or take other protective action while a dispute is reviewed.
Marlbank OLR reserves the right to make platform-level decisions regarding account restrictions, listing moderation, payout holds or internal enforcement, but does not guarantee that it will resolve every underlying private dispute between users.
12. Refunds, Returns and Reversals
Refunds, returns, reversals and transaction cancellations may depend on the nature of the item, the transaction structure, platform payment flow, buyer/seller conduct, evidence submitted, processor requirements and applicable law.
Marlbank OLR may impose or support refund restrictions, review procedures, return conditions, evidentiary requirements or payment reversal processes appropriate to the relevant transaction type.
Nothing in this policy guarantees that a refund, return or reversal request will automatically succeed.
13. Platform Moderation and Enforcement
Marlbank OLR may edit, reject, unpublish, suspend or remove listings, accounts, profile data, uploaded content, transaction capability, messaging privileges or payout access where reasonably necessary to protect users or enforce policy.
Moderation may be based on fraud indicators, abusive behaviour, policy breaches, legal concerns, deceptive content, verification failures, complaints, dispute history, suspicious transaction patterns or operational necessity.
14. Fraud, Abuse and Safety
Marlbank OLR may use automated and manual review methods to identify suspicious activity, unauthorised payment behaviour, account abuse, payout manipulation, listing fraud, identity inconsistencies, location/IP anomalies, unusual transaction patterns or other platform risks.
Users must cooperate with reasonable fraud-prevention and verification measures.
Where Marlbank OLR reasonably suspects fraud or abuse, it may suspend access, preserve records, block transactions, report unlawful conduct and take any additional protective steps considered necessary.
15. Limitation of Platform Responsibility
Marlbank OLR does not warrant that every seller is legitimate, every buyer will perform, every listing is error-free or every transaction will conclude successfully.
Users remain responsible for exercising judgment, reviewing available information, complying with platform rules and avoiding unsafe or suspicious transactions.
To the fullest extent permitted by law, Marlbank OLR is not liable for indirect or consequential losses arising from user-to-user marketplace dealings, except where the law requires otherwise.
16. Changes to this Policy
Marlbank OLR may update this Seller & Buyer Policy from time to time to reflect marketplace expansion, operational changes, legal requirements, payment controls, dispute-management practices or fraud-prevention measures.
Continued use of the marketplace after such changes are published constitutes acceptance of the revised policy.
