Payments & Marketplace Policy
This policy explains how Marlbank OLR may handle payments, buyer and seller activity, verification, payouts, marketplace listings, fraud prevention and transactional security across the platform.
This policy is intentionally robust because the platform is expected to process identity data, bank details, transaction records and payment workflows. POPIA and PCI DSS-aligned controls should be reflected not only in policy language, but also in how the live system is architected and operated.
1. Purpose of this Policy
This Payments & Marketplace Policy governs payment processing, buyer and seller activity, listing conduct, payout administration, fraud prevention, verification controls and related transactional activity conducted through the Marlbank One Loft Race platform.
This policy should be read together with the Marlbank OLR Terms of Service, Privacy Policy, official race rules and any transaction-specific notices, listing terms, fee schedules or marketplace instructions published on the platform from time to time.
2. Scope of Platform Transactions
The platform may support or later support race registrations, listing fees, auction payments, marketplace purchases, seller payouts, buyer transactions, deposit payments, service charges, transaction fees, withdrawal requests, refunds, reversals and related payment events.
The platform may also support the listing, promotion, buying and selling of pigeons, race-related goods, race-related services, auction items, managed-sale inventory or other approved products or offerings.
3. Payment Processing and Card Security
Where card payments are enabled, Marlbank OLR may use third-party payment processors, gateways or hosted payment environments to process, verify, tokenise or settle transactions.
Payment-card data requires heightened protection. PCI DSS is the payment-card industry baseline of technical and operational requirements designed to protect payment account data. Marlbank OLR may therefore rely on PCI-oriented or PCI-compliant payment service providers and may structure payment flows to minimise direct exposure of raw card data within ordinary platform systems.
Marlbank OLR reserves the right to reject, suspend, delay or limit card payment functionality until appropriate security, anti-fraud, operational and compliance measures are in place.
4. Bank Details, Payouts and Financial Verification
The platform may collect and process banking information for seller payouts, refunds, reimbursements, verification, reconciliation, fraud prevention, payment tracing, compliance review and operational administration.
Marlbank OLR may require account-holder verification, supporting documentation, confirmation of payment authority, proof of bank ownership or additional security checks before processing payouts, refunds or other financial movements.
Payouts may be delayed, withheld, reversed, frozen or cancelled where verification remains incomplete, where suspicious activity is identified, where a transaction is disputed, where chargeback risk exists, where listing legitimacy is in doubt, or where legal or compliance concerns reasonably require additional review.
5. Identity Verification and High-Risk Information
The platform may collect or process high-risk or sensitive information for lawful operational purposes, including identity numbers, company information, proof-of-identity documents, proof-of-address records, bank details, transaction history, IP-related data, device data, approximate location data and communications records.
Such information may be used for account creation, account recovery, seller onboarding, payout verification, fraud prevention, dispute handling, transaction security, legal compliance, anti-abuse measures, access control and internal investigations.
Where additional verification is requested, users must provide complete and truthful information. Failure to do so may result in access restrictions, transaction delays, withheld payouts, listing suspension or account closure.
6. Buyer Responsibilities
Buyers are responsible for reviewing listing details, pricing, supporting information, transaction terms, seller information, availability status, and any conditions communicated in connection with a purchase or auction.
Buyers must ensure that all payment information submitted is authorised, lawful and accurate, and that all purchases are made in compliance with applicable law and platform rules.
Buyers may not use stolen payment methods, false identities, manipulated credentials, false chargeback claims, abusive disputes or other deceptive payment conduct.
7. Seller Responsibilities
Sellers are solely responsible for ensuring that all listings are lawful, accurate, complete, non-misleading and supported by genuine authority to sell or offer the relevant item or service.
Sellers remain responsible for the accuracy of representations regarding identity, ownership, pedigree, authenticity, item condition, listing price, shipment terms, handover terms and any seller-provided supporting information.
Sellers may be required to complete identity verification, payout verification, anti-fraud checks, listing review, document submission or additional compliance review before listings are approved or before payouts are released.
8. Listings, Pricing and Marketplace Conduct
Marlbank OLR may review, moderate, edit, refuse, suspend or remove listings, pricing data, item descriptions, user-uploaded content, marketplace communications or related activity where reasonably necessary to protect users, preserve trust, support legal compliance, prevent fraud or maintain operational standards.
The platform may impose listing rules, fee schedules, approved categories, prohibited categories, auction rules, timing windows, payout cycles, withdrawal restrictions, communication limitations or transaction thresholds from time to time.
Users may not post deceptive, fraudulent, unlawful, harmful or manipulative listings or use the marketplace to exploit, scam, impersonate, harass or mislead others.
9. Fees, Charges and Commissions
Marlbank OLR may charge registration fees, listing fees, processing fees, service fees, buyer fees, seller fees, auction commissions, administrative charges, withdrawal charges, convenience fees or other charges in relation to transactions conducted through the platform.
Applicable charges may be displayed at checkout, within listing terms, in seller dashboards, in auction flows, in platform notices or in supporting fee schedules made available on the platform.
Unless otherwise expressly stated, such fees may be deducted, offset or retained before settlement or payout where applicable.
10. Refunds, Reversals and Chargebacks
Refund requests, reversals, cancellations and chargeback-related matters may be reviewed based on the nature of the transaction, the applicable platform rules, the seller/buyer relationship, processor requirements, dispute evidence and legal obligations.
Marlbank OLR may reverse credits, suspend access, delay settlement, freeze payouts, request supporting documentation or otherwise intervene where a transaction is disputed or reasonably suspected to be fraudulent, unauthorised, unlawful or abusive.
Nothing in this policy guarantees that a refund, reversal or dispute outcome will be decided in favour of a particular user.
11. Fraud Prevention, Monitoring and Risk Controls
Marlbank OLR may use automated or manual systems to monitor transactions, accounts, IP-related activity, device activity, listing behaviour, payout patterns, login activity, message patterns and other signals associated with fraud risk, abuse, unauthorised access, policy violations or suspicious conduct.
The platform may block, score, review, limit, delay or escalate transactions and may require extra steps such as email verification, document submission, OTP-style checks, manual review or seller approval before proceeding.
12. Data Protection and Security Safeguards
POPIA requires responsible parties to secure the integrity and confidentiality of personal information by taking appropriate, reasonable technical and organisational measures to prevent loss, damage, unauthorised destruction, unlawful access or unlawful processing.
Marlbank OLR may therefore implement access controls, role-based permissions, audit logging, data minimisation, document restrictions, processor controls, account protections, technical safeguards, backup measures and security-response procedures appropriate to transaction-related and identity-related data.
Where operators or service providers process personal information on behalf of Marlbank OLR, POPIA requires that such processing be subject to security and confidentiality obligations.
13. Security Incidents and Regulatory Response
Where there are reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, POPIA requires notification to the Information Regulator and affected data subjects, subject to the Act and applicable practical requirements.
Marlbank OLR may investigate incidents, preserve logs, suspend transactions, reset credentials, require account re-verification, pause payouts, engage incident-response specialists and take other protective steps where reasonably necessary.
14. No Guarantee of Continuous Availability
Payment tools, marketplace features, card processing, payout tools, auctions, listings, messaging systems and verification workflows may be interrupted, modified, restricted, paused or removed without prior notice where reasonably necessary for technical, security, operational, compliance or legal reasons.
Marlbank OLR does not guarantee that payment functionality or marketplace features will always be uninterrupted, error-free or available in every region, for every user or for every transaction type.
15. Reservation of Rights
Marlbank OLR reserves the right to reject payments, delay settlement, suspend payouts, decline listings, impose additional verification, limit user activity, request documentation, cancel suspicious activity, freeze transactions or restrict marketplace participation where reasonably required to protect users, preserve trust or comply with legal obligations.
Marlbank OLR also reserves the right to amend this policy, platform transaction rules or related procedures as the platform evolves.
16. User Acknowledgement
By using the platform’s registration, payment, listing, buying, selling, auction or payout features, you acknowledge and accept that financial transactions and marketplace conduct may be subject to verification, monitoring, moderation, legal compliance checks and security controls.
You further acknowledge that Marlbank OLR may rely on third-party processors, banking providers, verification providers and technical service providers to support platform payments and marketplace operations.
